Conditions d’utilisation
Terms & Conditions
These Terms & Conditions ("Terms") govern your use of the Corvani website and any purchases made through our website.
Please read these Terms carefully before using our website or placing an order.
Nothing in these Terms is intended to exclude, restrict or otherwise affect any mandatory rights you have under applicable consumer law.
1. About Us
The website and online store are operated by:
Corvani
Email: info@corvani.fr
Throughout these Terms, "Corvani", "we", "us" and "our" refer to the legal entity identified above.
"Website" means the Corvani website through which our products are offered for sale.
"Product" or "Products" means any goods offered for sale through our Website.
2. Application of These Terms
These Terms apply to:
-
Your use of our Website;
-
Orders placed through our Website; and
-
Contracts concluded between you and us for the purchase of Products.
By placing an order, you confirm that you have read and accepted these Terms.
You must have the legal capacity required under applicable law to enter into a binding purchase agreement.
If you do not agree with these Terms, you should not place an order through our Website.
3. Product Information
We take reasonable care to ensure that descriptions, photographs, prices and other Product information displayed on our Website are accurate.
However, colours and appearance may vary slightly depending on your device, screen settings and manufacturing variations.
Product images are intended to provide a reasonable representation of the Product but may not always represent every minor detail exactly.
Nothing in this section limits your statutory rights where a Product does not conform to the contract, its description or applicable legal requirements.
4. Prices
The price payable for a Product will be the price displayed during checkout when you place your order, subject to the provisions below concerning obvious pricing errors.
Prices will be displayed together with any applicable taxes and delivery charges as required by applicable law.
Any additional charges that are known and payable by the customer will be communicated before the customer completes the order.
Pricing errors
Despite our reasonable efforts, a Product may occasionally be displayed at an incorrect price.
If we discover an obvious pricing error before accepting or fulfilling your order, we may contact you and give you the option to:
-
Confirm the order at the correct price; or
-
Cancel the order and receive a full refund of any amount already paid.
We will not change the agreed price of an accepted order merely because the Product price changes afterwards.
5. Import Duties and Taxes
Depending on the destination country and the way an order is fulfilled, customs duties, import VAT or similar charges may apply.
Where such charges are not included in the price paid to us, we will provide the information required by applicable law before you place your order.
Customers will only be responsible for additional import charges where this has been clearly communicated before the order is placed and where permitted by applicable law.
6. Placing an Order
You may place an order by following the checkout process on our Website.
Before submitting your order, you will have an opportunity to review the Products selected, delivery information and total price and to correct any errors.
Submitting an order constitutes an offer to purchase the Products included in that order.
After placing your order, you may receive an automated email acknowledging receipt of your order.
Where applicable, a binding purchase agreement is formed when we accept your order, for example by sending an order confirmation or otherwise confirming acceptance in accordance with the checkout process and applicable law.
If we cannot accept or fulfil your order, we will inform you and refund any amount already paid for the affected Product or order.
7. Availability
All orders are subject to Product availability.
We may discontinue Products or change our Product range at any time. This will not affect Products already purchased under an existing contract.
If a Product becomes unavailable after you place an order, we will contact you as soon as reasonably possible.
If we cannot supply the Product, any amount already paid for that Product will be refunded.
8. Payment
Available payment methods are displayed during checkout.
Payments may be processed through third-party payment service providers.
You agree to provide complete and accurate billing and payment information and confirm that you are authorised to use the selected payment method.
We may take reasonable measures to prevent fraudulent or unauthorised transactions.
Nothing in these Terms restricts any statutory rights or legitimate rights you may have in relation to your payment provider.
9. Promotional Codes and Discounts
From time to time, we may offer promotional codes, vouchers or discounts.
Unless otherwise stated in the specific promotion:
-
Promotional codes must be entered during checkout;
-
Only one promotional code may be used per order;
-
Promotional codes cannot be exchanged for cash;
-
Promotional codes cannot normally be applied retrospectively; and
-
Promotions may have specific validity periods or eligibility requirements.
Additional terms communicated as part of a particular promotion may apply.
Your statutory consumer rights are not affected.
10. Delivery
We will deliver your order to the delivery address provided during checkout.
Please ensure that your delivery information is complete and accurate.
The estimated delivery time will be communicated through our Website, checkout process, order confirmation or shipping information.
Estimated delivery dates are estimates unless expressly stated otherwise or applicable law requires delivery by a particular deadline.
If we become aware of a significant delay, we will inform you where reasonably possible.
Your statutory rights in the event of late or non-delivery remain unaffected.
11. Multiple Shipments
Where an order contains multiple Products, those Products may be delivered separately.
You will not be charged additional delivery fees solely because we decide to split an order into multiple shipments unless this was expressly agreed with you.
12. Transfer of Risk
For consumer purchases, the risk of loss or damage generally passes to you when you, or a third party designated by you other than the carrier, physically receive the Products, subject to applicable law.
Different rules may apply where you independently appoint a carrier that was not offered by us.
13. Order Changes and Cancellations
If you wish to change or cancel an order, please contact us as soon as possible at:
Because orders may be processed quickly, we cannot guarantee that an order can be changed or stopped after processing or shipment has begun.
Where an order can still be stopped, we will make reasonable efforts to process your cancellation.
If the order has already been shipped, this does not remove any statutory right of withdrawal you may have.
Please refer to our Return & Refund Policy for further information.
14. Right of Withdrawal
If you are a consumer in the European Union or another jurisdiction providing a statutory withdrawal right for distance contracts, you may have the right to withdraw from your purchase without giving a reason.
For EU consumers, the statutory withdrawal period is generally 14 days from the date on which you, or a third party designated by you other than the carrier, receive the goods, subject to applicable exceptions.
Corvani additionally offers eligible customers a 30-day return period, as described in our Return & Refund Policy.
Our voluntary return policy does not replace or restrict your statutory withdrawal rights.
You may notify us of your decision to withdraw by sending a clear statement to:
For further information about returns, return costs and refunds, please see our Return & Refund Policy.
15. Exceptions to the Right of Withdrawal
The statutory right of withdrawal may not apply to certain Products where an exception is permitted by applicable law.
Depending on the circumstances, examples may include:
-
Products made to the consumer's specifications or clearly personalised;
-
Sealed Products that are not suitable for return for health-protection or hygiene reasons where the seal has been broken after delivery; and
-
Other Products specifically excluded from the statutory withdrawal right by applicable law.
An exception will only be applied where legally permitted.
16. Returns and Refunds
Our Return & Refund Policy forms part of these Terms and provides further information about:
-
Our 30-day return period;
-
Exercising the statutory right of withdrawal;
-
Return shipping;
-
Refunds;
-
Incorrect Products;
-
Damaged Products; and
-
Faulty or non-conforming Products.
Nothing in our Return & Refund Policy or these Terms limits your mandatory consumer rights.
17. Faulty or Non-Conforming Products
Products must comply with the contract and with applicable statutory conformity requirements.
If a Product is faulty, damaged, incorrect or otherwise non-conforming, please contact us at:
Please provide your order number, a description of the problem and, where reasonably useful, photographs showing the issue.
Depending on the circumstances and applicable law, you may be entitled to remedies including repair, replacement, price reduction or refund.
Where we are legally responsible for a faulty, damaged, incorrect or otherwise non-conforming Product, you will not be charged the necessary costs of returning the Product.
Nothing in these Terms excludes or restricts statutory guarantees or other mandatory consumer rights.
18. Intellectual Property
Unless otherwise stated, the Website and its content, including text, graphics, branding, logos, photographs, designs and other materials, are owned by or licensed to Corvani and are protected by applicable intellectual-property laws.
You may use the Website for your personal and non-commercial use.
You may not, without our prior written permission and except where permitted by law:
-
Reproduce substantial parts of our Website for commercial purposes;
-
Modify or commercially exploit our Website content;
-
Use our trademarks or branding in a misleading manner; or
-
Represent yourself as being affiliated with or endorsed by Corvani where no such relationship exists.
19. Acceptable Use
You must not use our Website:
-
For unlawful, fraudulent or malicious purposes;
-
To transmit malware, viruses or other harmful code;
-
To attempt to gain unauthorised access to our systems;
-
To interfere with the operation or security of the Website;
-
To place fraudulent or intentionally false orders;
-
To violate the rights of another person; or
-
In any other way prohibited by applicable law.
We may take reasonable action to protect the Website, our customers and our business where we reasonably believe these rules have been violated.
20. Website Availability
We aim to keep our Website available and functioning correctly, but we cannot guarantee uninterrupted or error-free access at all times.
We may temporarily suspend, restrict or modify parts of the Website for maintenance, security, technical or operational reasons.
Where reasonably possible, we will seek to minimise disruption.
21. Third-Party Links
Our Website may contain links to websites or services operated by third parties.
These links may be provided for convenience or information.
Unless expressly stated otherwise, we do not control or endorse independent third-party websites and are not responsible for their content or practices.
22. Privacy and Personal Data
We process personal data in accordance with our Privacy Policy and applicable data protection law.
Where consent is legally required for non-essential cookies or similar technologies, acceptance of these Terms alone does not constitute such consent.
Please review our Privacy Policy and Cookie Policy for further information.
23. Liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
In particular, nothing in these Terms excludes or restricts:
-
Mandatory statutory consumer rights;
-
Liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded;
-
Liability for fraud or fraudulent misrepresentation; or
-
Any other liability that cannot legally be excluded or limited.
To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from circumstances outside our reasonable control.
If you purchase Products as a consumer, we do not exclude or restrict liability in a manner that would deprive you of remedies provided by mandatory consumer law.
24. Force Majeure
We will not be responsible for a failure or delay in performing an obligation where the failure or delay results from circumstances beyond our reasonable control, to the extent permitted by applicable law.
Such circumstances may include major transportation disruptions, natural disasters, governmental measures, widespread telecommunications failures or other events that could not reasonably have been prevented.
This provision does not affect any mandatory consumer rights, including rights relating to non-delivery or reimbursement.
25. Changes to These Terms
We may update these Terms from time to time, for example because of changes to our business, Website or applicable law.
The Terms applicable to your purchase will generally be those in effect when you place your order.
Changes made after a contract has been concluded will not retrospectively reduce your contractual or statutory rights.
The current version of these Terms will be published on our Website.
26. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply to the maximum extent permitted by law or, where appropriate, be treated as severed.
The remaining provisions will continue to apply.
27. No Waiver
If we do not immediately exercise a right or remedy available to us under these Terms or applicable law, this does not mean that we waive that right or remedy.
28. Applicable Law and Jurisdiction
These Terms and contracts concluded through our Website are governed by [APPLICABLE LAW / COUNTRY], subject to any mandatory consumer-protection rules that apply to you.
If you are a consumer residing in the European Union, this choice of law does not deprive you of mandatory consumer protections available to you under the laws that would otherwise apply.
Any disputes may be submitted to the courts having jurisdiction under applicable law. Nothing in these Terms requires a consumer to waive a mandatory right to bring proceedings before a court that has jurisdiction under applicable consumer law.
29. Complaints
If you have a complaint about a Product, order or our service, please contact us first so that we can try to resolve the matter.
Email: info@corvani.fr
We will endeavour to respond within a reasonable period.
Where applicable, consumers may also have access to an authorised consumer mediation or alternative dispute resolution procedure. Information about any legally required mediation service will be provided on our Website or upon request.
